Sunrise Nursing Home Abuse Lawyer
Attorneys Helping Nursing Home Accident Victims throughout South Florida
We have handled many nursing home cases in Sunrise and the surrounding South Florida area for many years. Our law firm handled our first nursing home case in about 1989, and since then we have handled (or reviewed) hundreds more. Before putting a loved one in a nursing home, it is not sufficient to simply go visit the facility. Many nursing homes put on this ‘front’, but you don’t see what goes on, particularly on the night shift. Staffing shortages is the biggest issue. People calling in sick on night shifts (when family usually does NOT visit) are one of the main reasons that residents are injured in nursing homes. Many times a resident needs to use the bathroom, and despite using the call bell, nobody comes, so the residents gets up themselves, as they don’t want to have an ‘accident’ in bed. They fall, and the rest is history.
The best thing you can do for your loved one is to look at the inspections of the nursing homes rated by Medicare. This is the best way to get ratings of the nursing home from the government. Many of these ratings result from surprise ‘visits’ (inspections) when the facility is not expecting it, which is of course, the best way to see what’s really going on..
Many victims of nursing home abuse do not report their abuse because they fear retaliation from the abuser. It is often up to family members or friends of the victims to observe changes in behavioral patterns and confront the individual. It is important for family members of individuals living in nursing homes to be aware of signs of elder abuse. The following is a list of warning signs of elder abuse provided by The Department of Health and Human Services:
- Physical abuse (hitting, bruising, restraining, etc.)
- Sexual abuse
- Failure to provide food, hygienic services, or the appropriate health care required for the individual
- Exploitation such as taking, or misusing money, jewelry, or other valuable assets from the individual for another person’s benefit
- Emotional abuse such as humiliating, intimidating, or threatening the elderly person
- Abandonment
- Self-neglect – characterized as the failure of a person to perform essential, self-care tasks and that such failure threatens his/her own health or safety
