Personal Injury Lawyer Handling Podiatry Malpractice Cases
Are you the victim of an unnecessary podiatric surgery that has left you with pain or an infection or permanent damage? Are you looking for a personal injury attorney in Florida to advise you on the best steps to take after your podiatry malpractice injury? Our personal injury firm handles malpractice by podiatrist cases and is aware of the risks involved with procedures by podiatrists.
Podiatrists love to do surgery. That's a big moneymaker for them, especially if they can charge cash. Many times podiatrists tend to do too much--such as reconstructing the foot. Unfortunately, a lot of podiatrists are not the most confident of physicians. Although they are licensed, podiatrists don’t attend medical school per se and are not medical doctors.
The most common malpractice cases that you'll see regarding podiatrists are when they attempt to do too much. Often times, they'll attempt to reconstruct the foot, which can end up with a very bad painful result. Infection is also a common reason for podiatry malpractice claims. We have handled podiatry malpractice claims, but generally, we're unwilling to get involved unless the injuries are very serious.
One of the podiatry malpractice cases that we handled was a case where the podiatrists performed what was determined by our expert podiatrist to be an unnecessary bunionectomy, also called an arthrodesis of the toes. The woman came to us through a referral when we received phone call while she was hospitalized, complaining that she was hospitalized for approximately one week due to an infection following this bunionectomy. We filed a lawsuit on the case, and settled for a very fair result.
We handled the case of a client who went to a podiatrist because she was suffering from left foot pain. The podiatrist diagnosed our client with plantar fasciitis, which is the inflammation of the ligament that connects your heel bone to your toes and is a common cause of heel pain. The podiatrist acted negligently by performing surgery without first trying more conservative measures that could have helped. In addition, the podiatrist did not discuss the risks and benefits of surgery and did not perform pre and post operative studies.
Due to our client’s continuing pain, the podiatrist recommended getting a second opinion where another surgery was recommended. The second podiatrist acted negligently by not conducting nerve conduction tests, which would have shown the exact location of the client’s nerve entrapment. In addition, the podiatrist failed to use other options before recommending surgery. After the second surgery, the podiatrists acted negligently by failing to do the surgery adequately, and ultimately resulted in our client suffering nerve impairment in her foot and a third surgery. That case also resulted in a settlement satisfactory to our client.
