Most of the time, nursing home abuse cases involve bed sores, which are also known as decubitus ulcers. Bed sores typically develop due to prolonged pressure on the skin from immobility. Other times, they can develop as a result of leaving a person who is incontinent in soiled clothes. When a person is soiled with either urine or feces for an extensive amount of time, decubitus ulcers can develop. Bed sores can be prevented simply by turning a patient frequently and having them shift their weight. Sadly, many people develop bed sores at nursing home because caregivers fail to provide adequate care.
Mr. Cytryn, the founding attorney of our personal injury firm has handled numerous cases involving victims of nursing home abuse. One of the cases he handled involved an elderly woman who developed bed sores. In this case, the defendant facility’s staff charting failed to show that our client had been bathed or received any kind of hygienic services for more than a week.
In addition, the charts failed to show she had received dinner for 6 days in a row, and no treatment for the bed sores was documented. Upon investigation, the jury found the nursing home’s negligence to be responsible for our client’s injuries. The best offer was $150,000. Unfortunately, our client passed away before the case settled due to natural causes. Subsequently, the jury awarded $959,900 for the case, including punitive damages. The case went up on appeal, and we established some more new law in the state of Florida. The recovery for the case was given to the client’s daughters.
If you are living in a nursing home or have a loved one living in a nursing home, it’s important to be familiar with the care that should be provided in order to prevent decubitus ulcers from forming. The following are preventive measures that should be provided by nursing home caregivers:
- Frequently changing a patient’s position both in a chair and in bed
- Maintaining the patient’s hygiene which may require bed baths if the patient is immobile
- Changing bed linens and clothing regularly
- Providing adequate nutrition
- Proper administration of medications
